国家土地管理局关于执行《城市房地产管理法》和国务院5号令有关问题的批复

湖南省国土测绘管理局、福建省土地管理局:
你们先后报送的《关于贯彻执行<城市房地产管理法>和国务院55号令有关
问题的请示》(湘国土测绘办函〔1996〕第13号)和《关于如何适用法律对
出租划拨土地使用权及地上建筑物行为进行管理问题的请示》(闽土法监函〔19
96〕027号)收悉。中文所提问题涉及到《城市房地产管理法》和《城镇国有
土地使用权出让和转让暂行条例》即国务院55号令在执行中如何衔接问题。为了
确保《城市房地产管理法》和国务院55号令的正确贯彻实施,进一步加强土地管
理,维护土地市场秩序,根据全国人大常委会《关于加强法律解释工作的决议》的
有关规定,现就法律应用问题,作如下批复:
一、关于国务院55号令与《城市房地产管理法》(以下简称法律)在执行中
如何衔接的问题。法律施行后,国务院55号令继续有效,国务院55号令的规定
与法律的规定相一致的,应结合起来执行;法律没有规定而国务院55号令已有明
确规定,应按国务院55号令执行;法律虽有原则规定,但根据法律规定必须依照
国务院规定执行的,在国务院新的规定出台之前,应按国务院55号令或国务院其
他有关规定执行;国务院55号令有关条款与法律规定不一致的,应当依照法律的
规定执行。
二、划拨土地使用权转让审批问题,应当按照《城市房地产管理法》第三十九
条第一款的规定执行,即“以划拨方式取得土地使用权的,转让房地产时,应当按
照国务院规定,报有批准权的人民政府审批。”目前,国务院尚未对人民政府审批
划拨土地使用权转让的权限作出新的规定,应按国务院原有规定《关于出让国有土
地使用权批准权限的通知》(国发〔1989〕49号)关于“政府对有偿出让国
有土地使用权的权限,应与行政划拨国有土地使用权的批准权限相同”的规定执行,
不宜再按国务院55号令关于由市、县人民政府有关部门审批的规定执行。
三、《城市房地产管理法》第三十九条第一款所称“受让方”,应是指原划拨
土地使用权人即转让方的对应方。《城市房地产管理法》施行后,市、县人民政府
土地管理部门应按该法第三十九条第一款的规定,与受让方签订出让合同,不宜再
按国务院55号令的有关规定,与划拨土地使用权转让方签订出让合同。
市、县人民政府土地管理部门在办理有关出让手续时,应依照《城市房地产管
理法》、国务院55号令等行政法规及地方性法规、国家土地管理局和各省级人民
政府的有关规章进行审查,其中也包括对受让方主体资格的审查。出让合同应根据
《城市房地产管理法》和国务院55号令的规定,参照国家土地管理局和国家工商
行政管理局正式颁布的“国有土地使用权出让合同示范文本”签订。
四、《城市房地产管理法》第三十九条第二款规定,经过批准,划拨土地使用
权人转让房地产也可以不办理出让手续。这是只有在具备法定条件下才能适用的条
款,即有批准权的人民政府必须按照国务院的规定,才能决定有关当事人可以不办
理出让手续;划拨土地使用权转让方虽经批准可以不办理出让手续,但要按照国务
院的规定缴纳有关土地收益。目前,有些地方片面理解第三十九条第二款的规定,
在国务院有关规定尚未出台的情况下,擅自批准划拨土地使用权人不经办理出让手
续转让房地产,甚至一些划拨土地使用权人不经依法批准未办理出让手续也不依法
缴纳有关土地收益就擅自转让房地产,不仅违反了第三十九条第二款的规定,也使
第三十九条第一款不能正常贯彻执行,造成土地市场混乱。为制止各种非法转让行
为发生,维护土地市场的正常秩序,防止国有土地收益流失,在国务院有关规定出
台之前,转让划拨土地使用权应暂按国务院55号令第四十四、四十五条规定执行,
有关审批和出让手续,应按《城市房地产管理法》第三十九条第一款的规定执行,
国务院新的规定出台后,按新的规定执行。
五、《土地管理法》和《城市房地产管理法》都是全国人大常委会制定的法律,
前法中的第四十七条和后法中的第六十六条也都是有关非法转让土地的处罚条款,
在处理非法转让土地案件中应当同样有效,但各自的适用范围有所不同。当事人
违反《城市房地产管理法》第三十九条第一款的规定,未经依法批准擅自转让房地
产的,有批准权的人民政府经审查如准予转让,县级以上人民政府土地管理部门应
当依据该法第六十六条的规定予以处罚。除此之外,均应按《土地管理法》第四十
七条和国务院55号令的有关规定处理。
六、根据《城市房地产管理法》第五十五条的规定,房屋所有权人以营利为目
的,将以划拨方式取得使用权的国有土地上的房屋出租的,应当上缴租金中所含的
土地收益,实施该条的具体办法由国务院制定。目前,国务院尚未制定具体办法,
应暂按国务院55号令第四十四、四十五条的规定执行。国务院有关实施第五十五
条的具体办法出台后,按该办法执行。当事人未经批准,擅自将划拨土地使用权连
同地上建筑物出租的,应当认定其租赁行为违反国务院55号令第四十四、四十五
条的规定,应按照国务院55号令第四十六条的规定给予行政处罚。
七、关于土地管理部门与受让方签订出让合同是作为行政行为还是民事行为,
土地管理部门依出让合同承担的违约赔偿责任是行政责任还是民事责任问题,是对
法律的进一步界定,根据全国人大常委会《关于加强法律解释工作的决议》规定,
此类问题应由全国人大常委会解释。
八、你们在请示中涉及的其他有关法律的应用问题,可按国家土地管理局《关
于贯彻<城市房地产管理法>若干问题的批复》(国土批〔1995〕13号)一
并执行。

PART I PRELIMINARY

Ordinance may be cited as the Consumer Council Ordinance.

his Ordinance, unless the context otherwise requires--
ncil" means the Consumer Council incorporated by section 3 (1);

PART II INCORPORATION AND POWERS
ncorporation of Consumer Council
The Consumer Council existing at the commencement of this
Ordinance is

The Governor may be notice in writing to the Council

In subsection (1) and in section 5 (2) (c) "goods and services"

The Council shall consist of the following members--
a Chairman who shall be appointed by the Governor for a
term not

The Chairman, Vice-Chairman and any other member

Appointment of staff and advisers
Subject to subsection (4), the Council shall appoint a person to

PART III FINANCIAL
Resources of Council
The Governor may, out of money appropriated for the purpose

money paid to the Council by way of donations, fees,
subscriptions,
and interest;
all other money and property, including accumulations of

Borrowing powers
Council may, with the approval of the Financial Secretary,
borrow or
rwise raise money and charge all or any part of its

Investment of funds

The Council shall keep proper accounts and proper records in

PART IV GENERAL
Council not servant or agent of Crown
Council is not a servant or agent of the Crown and does not enjoy
any
us, immunity or privilege of the Crown.
Governor may give directions
The Governor may, if he considers that the public
interest so
ires, give to the Council such directions as he thinks
fit with
ect to the exercise and performance by the Council of its
powers,
tions and duties under this Ordinance, either generally or
in any

The Council shall comply with any direction given to
it under
ection (1).
Protection of members of Council and committees
No member or employee of the Council or of any committee
of the
cil shall be personally liable for any act done or default made--
by the Council; or
by any committee of the Council, acting in good faith in the course
of
operations of the Council or of the committee.
The protection hereby conferred on members and employees
of the
cil or of a committee in respect of any act or default shall not
in
way affect any liability of the Council for that act or default.
Prohibition of exploitation of the Council's name for
advertisement
oses
No person shall, with a view to promoting or disparaging any
s, services or immovable property or promoting the image
of any
on, publish or cause to be published any advertisement which
either
essly or by implication makes reference to--
the Council;
any committee, member, agent or employee of the Council;
the Council's publication or finding of tests or surveys
conducted by
n behalf of the Council; or
any other information published by the Council, without
written
ent of the Council.
Any person who contravenes subsection (1) commits an offence
and is
le to a fine of $ 100,000.
For the purpose of subsection (1) "advertisement" may be
constituted
ny words, whether written or spoken, or any picture, drawing,
visual
e, figure or article--
appearing in any publication; or
brought to the notice of the public or any section of the public
in

Transitional provisions
All property of whatever kind and whether movable or immovable
vested
r belonging to the Consumer Council existing at the
commencement of
Ordinance shall as from that date vest in or belong to that
Council
ts corporate capacity without any further assurance.
All obligations and liabilities of the said Consumer Council
are as
the commencement of this Ordinance the obligations and
liabilities of
Council in its corporate capacity.
Where anything has been commenced by or under the authority
of the
Consumer Council before the commencement of this Ordinance such
thing
be carried on any completed by the Council in its corporate
capacity.
Every person who immediately before the commencement of this
Ordinance
s an appointment as Chairman, Executive Director or a member of
the
Consumer Council is, as from such commencement but subject to
the
s of his appointment, the Chairman, Executive Director, or a
member of
Council, as the case may be, for the purposes of this Ordinance.
Notwithstanding the definition of "financial year" in section
2 the

No stamp duty shall be payable in respect of any transfer of

民航空勤人员运输飞行小时费暂行规定

根据运输飞行小时费制度试行以来存在的问题,为进一步贯彻按劳分配原则,调动空勤人员的生产积极性,更好地保证飞行安全,改善服务工作,提高经济效益,现结合今年企业的工资改革,将原暂行规定修订如下:
一、定员
(一)机组定员
1.五人制:机长、副驾驶、领航员、空勤机械员、空勤报务员各一人。
2.三人制:机长、副驾驶、空勤机械员各一人。
3.二人制:机长、副驾驶各一人。
值勤时间(包括航前一个半小时,航后一小时,过站及空中时间均按班机时刻表规定的时间计算)在十一小时以上的航线派双机组,十一小时(不含)以下的派单机组,有带飞或检查任务时,包括教员、检查员和被带飞人员在内,单机组最多可增加二人,双机组在定员内安排。
(二)乘务组定员
乘务人员(含主任乘务长、乘务长)有配餐任务的每二十五~三十客座配一人;无配餐任务的每三十五~四十客座配一人。各型飞机的标准定员一般为:波音747(SP、COMBI)配主任乘务长一人,乘务长二人,乘务员九人;波音707、MD--80、伊尔62、图154M、波音737--300配乘务长一人,乘务员四人;波音767、A310配乘务长一人,乘务员七人;波音737--200、三叉戟、伊尔18配乘务长一人,乘务员二人(国际线三人);安24配乘务长一人,乘务员一人;肖特360、伊尔14、里二配乘务员一人。
以上标准可根据实际旅客人数适当调整。
(三)安全员根据规定与任务需要派出,国际航线飞行每次最多不超过两人。
(四)专、包机按实际需要配备机组和乘务人员。
二、飞行小时费的标准和发放办法
(一)飞行小时费按机组、乘务组定员和空中实际飞行时间计发,其日间标准为:

凡在规定定员内的空勤人员(含双机组)均执行此标准。
(二)符合下列情况者,其飞行小时费标准可分别提高:
1.执行拉萨航线飞行任务的机组人员各提高0.20元,乘务、安全人员各提高0.15元。
2.夜间飞行时,机组人员各提高0.20元,乘务、安全人员各提高0.10元。
3.三人制机组,机长和副驾驶分别在正副驾驶的标准上各提高0.40元。
4.二人制机组,机长和副驾驶分别在正副驾驶的标准上各提高0.60元。
5.飞行、领航、空勤机械、空勤报务检查员和教员在执行检查或带飞任务时各提高0.20元,乘务检查员、教员在执行检查或带飞任务时按主任乘务长标准领取。
6.本场训练飞行时,教员提高0.30元,机组其他成员(被带飞者除外)提高0.20元。
7.机组人员执行一般试飞任务时,在原职务标准上各提高0.20元;执行大修出厂飞机试飞任务时,各提高0.40元;执行专机试飞任务时不提高。
8.单机组连续飞行值勤时间若超过十一小时(但最多不得超过民航局(81)民航航字第153号文件规定的飞行时间和值勤时间)机组成员超时部分的飞行小时费按本职务标准的140%计发。
9.驻兰州地区的空勤人员,其飞行小时费每月增发4%;驻乌鲁木齐地区的空勤人员,其飞行小时每月增发26%;驻广东地区的空勤人员,其飞行小时费每月增发25%。
(三)属于下列情况者,其飞行小时费不发或少发。
1.超过规定定员的空勤人员不发飞行小时费。
2.不是结合生产进行的熟练、训练飞行,熟练和受训的空勤人员不发飞行小时费。
3.航校毕业或地升空后未放单飞的领航员、空勤机械员、空勤报务员不发飞行小时费;毕业或地升空后直接上大型机的,一年后可按本职务标准的50%计发飞行小时费。
4.转机型和国内航线已放单飞的领航员、空勤机械员、空勤报务员以及定员内的乘务员,在结合生产被带飞时,按本职务飞行小时费标准的50%计发飞行小时费。
5.国际航线已放单飞的正驾驶,在熟悉航线被带飞时按标准的80%计发飞行小时费。
(四)飞行小时费基数和固定津贴
1.坚持正常生产的空勤人员(包括疗养,在国内派出工作或学习三个月以内的空勤人员),除按本职务国内航线日间标准发给相当于二十小时飞行小时费的小时费基数外,按实际飞行小时和有关规定计发飞行小时费。分三种不同情况:①当月国内航线飞行时间在四十小时(含)以内的,按标准的50%计发;超过四十小时的,其超过部份按标准的100%计发。②当月国际(含香港地区,下同)航线飞行时间在四十小时(含)以内的,按标准(以美元为单位)的100%计发的同时,要按标准(以人民币为单位)的50%扣回人民币;超过四十小时的,其超过部份按标准(以美元为单位)的100%计发。③当月在国内和国际两种航线上飞行的,国内航线飞行部份小时费的计发同第一种情况。若国内航线飞行时间不足四十小时(含),可用四十小时去减国内航线飞行小时,差值范围内的国际航线飞行小时,按标准(以美元为单位)100%计发并按标准(以人民币为单位)的50%扣回人民币。差值范围外的不扣。
〔例〕某一般机型正驾驶,当月国内航线飞行20小时,国际航线飞行30小时,除已发的飞行小时费基数外,还应计发飞行小时费(夜航与国外另用费等暂忽略不计)数额:
20小时×1元/小时×50%+20小时×(1美元/小时--1
元/小时×50%)+10小时×1美元/小时
=10元+20美元--10元+10美元
=30美元
即:当月除发给该正驾驶20元的小时费基数外,还应发给30美元的飞行小时费。
又:若上例当月国内航线飞行20小时,国际航线飞行10小时,则飞行小时费的计算应为:
20小时×1元/小时×50%+10小时×(1美元/小时--1
元/小时×50%)
=10元+10美元--5元
=5元+10美元
即:当月除发给该正驾驶20元的小时费基数外,还应发给10美元和5元人民币的飞行小时费。
2.运输飞行大队(含)以上的领导干部和各级机关(含民航局机关)的运输空勤人员,每月按本职务国内航线日间标准发给相当于二十小时飞行小时费的固定津贴,然后再按本暂行规定和实际飞行时间发给飞行小时费。计发飞行小时费的时间,大队干部每月不超过五十小时,总队和机关干部每月不超过四十小时,超过的部份不发飞行小时费(从事教学飞行的可不受此限制)。
(五)提高标准和改变办法后所增加的飞行小时费,在民航实行工资总额随同经济效益挂钩浮动之前,国内航线部分从各企业的自有奖励基金开支,国际和香港地区航线部分在成本中列支。各级机关的空勤人员参加生产、训练飞行时的飞行小时费由飞行队支付,固定津贴由本人所在机关支付。所有的空勤人员不再评发地面人员的各种奖金。
(六)运输飞行小时费,亦可根据本文规定的标准和办法分别对不同机型计算出每条航线的标准,然后再在空勤组内按规定比例进行分配(举例说明附后)。准备采用这种办法的单位可将航线、机型、标准的具体意见报局审定,由局统一公布实行。
〔例〕某国内航线,全长2000公里,其中有500公里为夜航,使用“一般”机型,时速800公里,不配餐,该航线的小时费标准为:
(1)五人制机组

(七)空勤人员未达到岗位责任制度要求的,要减发、停发直至扣发飞行小时费。具体办法由各管理局、公司制定颁发,报局备案。
